1. Introduction
These Terms and Conditions govern the provision of landscaping, garden design, and related services by Smart Gardens (“we”, “us”, “our”) to you (“the client”). By engaging our services or using this website, you agree to these terms in full.
2. Consultations & Quotations
- Initial consultations are provided free of charge and are without obligation.
- All quotations are valid for 30 days from the date of issue unless otherwise stated.
- Quotations are based on information provided by the client and a site assessment. If site conditions differ materially from what was assessed, we reserve the right to revise the quotation.
- A written acceptance of the quotation, along with the agreed deposit, is required before work commences.
3. Deposits & Payment
- A deposit of 30% of the total project cost is required to secure your start date.
- For larger projects, a staged payment schedule will be agreed in writing before work begins.
- Final payment is due upon satisfactory completion of the project, unless a staged schedule applies.
- We accept bank transfer, cheque, and cash. Late payments may incur interest at 2% per month.
4. Project Timeline
We provide estimated start and completion dates in good faith. Timelines may be affected by weather conditions, material availability, access constraints, or changes requested by the client. We will communicate any significant delays as soon as possible. Delays caused by factors outside our control do not constitute a breach of these terms.
5. Changes & Variations
Any changes to the agreed scope of work must be confirmed in writing. Changes may affect the project cost and timeline. We will provide a revised quotation for any significant variations before proceeding.
6. Materials & Workmanship
- We use high-quality materials sourced from reputable suppliers in Ireland and Europe.
- Natural stone and timber may vary in colour, texture, and grain. These variations are part of the material.
- All work is carried out to a professional standard by our experienced team.
- We provide a 12-month workmanship guarantee from the date of project completion.
7. Guarantees & Warranties
Our guarantee covers:
- Workmanship: 12 months for structural and installation work.
- Plants: a 3-month establishment guarantee when our aftercare instructions are followed.
- Materials: manufacturer warranties apply and are passed through to the client.
Guarantees do not cover damage caused by misuse, neglect, extreme weather events, unauthorised modifications, or failure to follow aftercare advice.
8. Client Responsibilities
- Provide reasonable access to the work site, including vehicle access for machinery and materials.
- Ensure pets and children are kept away from the work area for safety.
- Notify us of any underground services (water, gas, electric, drains) that may be affected.
- Obtain any necessary planning permissions, local authority consents, or management company approvals before work commences.
9. Cancellation
If you wish to cancel after paying a deposit, please notify us in writing as soon as possible. Deposits are non-refundable if materials have been ordered or work has commenced. If cancellation occurs before materials are ordered, we will refund the deposit minus a reasonable administration fee.
10. Liability
Smart Gardens carries public liability insurance and employer liability insurance. Our liability for any claim is limited to the total project value. We are not liable for indirect or consequential losses.
11. Website Use

12. Governing Law
These terms are governed by the laws of Ireland. Any disputes will be subject to the jurisdiction of the Irish courts.
